“Obey the Court”: Lawyer Calls Out ICPC Over Alleged Denial of Doctor, Family Access to El-Rufai


ABUJA —Human rights lawyer Hamza N. Dantani has urged the Independent Corrupt Practices and Other Related Offences Commission (ICPC) to immediately comply with court orders and grant former Kaduna Governor Nasir El-Rufai access to his doctor and family.

In a letter to the ICPC Chairman, Dantani said public statements by El-Rufai’s wife, Aisha El-Rufai, allege that her husband was denied food brought by relatives and barred from seeing his personal physician despite a subsisting court order guaranteeing access.

The lawyer described the claims as raising “grave constitutional and legal concerns” about fundamental rights, the rule of law, and respect for judicial directives.

Dantani cited Sections 34, 35, 36, and 46 of the 1999 Constitution, which protect dignity, liberty, fair hearing, and enforcement of rights, alongside Articles 5 and 16 of the African Charter on Human and Peoples’ Rights. He referenced Supreme Court rulings in Lagos State v. Ojukwu, Garba v. University of Maiduguri, Fawehinmi v. Abacha_, and Agbakoba v. SSS to stress that agencies must obey court orders.

“Where there exists a valid and subsisting order of court directing that a detainee be granted unrestricted access to his doctor and family members, any act inconsistent with such a directive may amount to disobedience of court orders, executive recklessness, and a violation of constitutionally guaranteed rights,” he wrote.

As a Senior Advocate of Nigeria and former Attorney-General, Dantani said the ICPC’s credibility hinges on operating within constitutional limits. He called on the commission to ensure immediate compliance with court orders, unhindered access to El-Rufai’s doctor and family, respect for his rights, and professional conduct by officers.

“Anti-corruption efforts, no matter how noble, must always be pursued within the framework of constitutionalism, human dignity, and the supremacy of the law,” he stated.

El-Rufai has been in ICPC custody since 18 February 2026. The commission has not publicly responded to the allegations.
